CEO: Built To Win

1. Acceptance of Terms

By downloading, installing, accessing, or using the CEO ("Built To Win") application ("App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you must not access or use the App.

These Terms constitute a legally binding agreement between you and CEO. Your continued use of the App following the posting of any changes to these Terms will mean you accept those changes.

2. Description of Service

CEO is a comprehensive personal life planning, journaling, and productivity application that enables users to:

  • Create and manage multiple personal journals with customisable features
  • Set, track, and complete goals across various life categories (Career, Health, Education, Finance, Relationships, Personal Growth, Fitness, Creativity, Social, Spiritual, and Custom)
  • Build, monitor, and maintain daily habits with streak tracking
  • Write daily journal entries with mood tracking and reflection prompts
  • Create and organise notes with rich text support
  • Manage to-do lists with priority levels, scheduling, and Pomodoro timer integration
  • Use calendar features for event planning and daily notes
  • Collaborate with partners on shared journals via invitation system
  • Generate and share achievement cards on social media
  • Access the App across web, iOS, and Android platforms

The App is designed for personal use, self-improvement, and productivity purposes. CEO reserves the right to modify, suspend, or discontinue any aspect of the service at any time.

3. Eligibility and User Accounts

To use the App, you must:

  • Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)
  • Sign in using a valid Google account or use anonymous authentication for trial purposes
  • Provide accurate and complete information during registration
  • Maintain the confidentiality and security of your account credentials
  • Notify us immediately of any unauthorised use of your account

Anonymous accounts provide limited access and may be subject to data loss. We strongly recommend signing in with a Google account for full functionality and data persistence.

You are solely responsible for all activities that occur under your account, whether or not you authorised such activities. CEO shall not be liable for any loss or damage arising from your failure to maintain the security of your account.

4. User Content and Intellectual Property

Ownership of User Content:
You retain full ownership of all content you create within the App, including but not limited to journals, goals, habits, entries, notes, to-do items, calendar events, and any other data you input ("User Content").

Licence Grant:
By using the App, you grant CEO a limited, non-exclusive, worldwide, royalty-free licence to store, process, display, and transmit your User Content solely for the purpose of providing, maintaining, and improving the service. This licence terminates when you delete your content or your account.

Content Restrictions:
You agree not to create User Content that:

  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or offensive
  • Infringes on any patent, trademark, copyright, or other intellectual property rights
  • Contains malware, viruses, or any harmful code
  • Violates the privacy or publicity rights of any third party
  • Contains unsolicited advertising or spam
  • Impersonates any person or entity

App Intellectual Property:
The App, including its design, features, branding, logos, user interface, and underlying technology, is protected by copyright, trademark, and other intellectual property laws. You may not:

  • Copy, modify, adapt, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Use CEO trademarks, logos, or branding without prior written permission
  • Remove or alter any copyright, trademark, or proprietary notices

5. Shared Journals and Collaboration

When you create a shared journal and invite a partner:

  • Both parties will have the ability to view and edit shared content within the journal
  • Each party is solely responsible for the content they contribute
  • The journal owner retains administrative control over journal settings
  • Either party may leave the shared journal at any time
  • A secure PIN system protects the invitation and sharing process
  • Upon leaving a shared journal, content separation will be handled according to our data policies

CEO is not responsible for disputes between journal partners, content contributed by other users, data loss from a partner leaving, or unauthorised access resulting from shared PIN codes.

6. Privacy and Data Protection

Your privacy is of paramount importance to us. Please refer to our Privacy Policy for comprehensive information about how we collect, use, store, and protect your personal data.

Key privacy commitments:

  • Your data is stored securely using Firebase/Google Cloud Platform with industry-standard encryption
  • We do not sell, rent, or trade your personal information to third parties
  • You maintain full control over your data and can export or delete it at any time
  • We process data only as necessary to provide and improve our services
  • We comply with applicable data protection regulations including GDPR and CCPA where applicable

7. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the App in any way that violates applicable local, national, or international law
  • Attempt to gain unauthorised access to any part of the App or its systems
  • Interfere with or disrupt the integrity or performance of the App
  • Use automated scripts, bots, or scrapers to access the App
  • Attempt to probe, scan, or test the vulnerability of the App
  • Upload or transmit any malicious code or content
  • Use the App to harass, abuse, or harm another person
  • Circumvent any security or authentication measures

8. Social Sharing Features

The App includes features that allow you to generate and share achievement cards on social media platforms. By using these features:

  • You acknowledge that shared content becomes visible to others on the platforms you share to
  • You are responsible for the content you choose to share publicly
  • CEO branding may appear on generated achievement cards
  • Shared images are generated locally on your device and are not stored on our servers
  • Gallery save functionality requires appropriate device permissions

9. Disclaimers and Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CEO does not warrant that:

  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • The App will be compatible with all devices or operating systems
  • Data will never be lost or corrupted

You acknowledge that you use the App at your own risk. You are responsible for maintaining independent backups of any important data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CEO, ITS DEVELOPERS, AFFILIATES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

This limitation applies to, but is not limited to: loss of data, content, or user-generated material; loss of profits, revenue, or business opportunities; loss of goodwill or reputation; emotional distress or mental anguish; cost of procurement of substitute services; and any matter beyond our reasonable control.

11. Indemnification

You agree to indemnify, defend, and hold harmless CEO, its developers, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with your use of or access to the App, your violation of these Terms, your violation of any third-party rights, or any content you submit, post, or transmit through the App.

12. Account Termination

Termination by You:
You may delete your account at any time through the App settings. Upon deletion, all your data will be permanently removed in accordance with our data retention policy.

Termination by CEO:
We reserve the right to suspend or terminate your account, without prior notice, if you violate these Terms or any applicable laws, engage in fraudulent, abusive, or illegal activity, misuse the service or attempt to harm other users, or create multiple accounts for deceptive purposes.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall continue in effect.

13. Modifications to Terms

CEO reserves the right to update, modify, or replace these Terms at any time at our sole discretion. Material changes will be communicated through in-app notifications, email to your registered address (if applicable), and a prominent notice within the App. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CEO regarding your use of the App and supersede all prior agreements, understandings, and representations.
